WITN Racing Challenge Contest
This local contest is presented by WITN in conjunction with UPICKEM Auto Racing Contest (“National Contest”), presented and sponsored by Second Street Media, Inc. (“Second Street”). Your entry and participation in the National Contest serves as your entry and participation in this local contest located in the State of North Carolina; you only have to enter once. WITN is not responsible for the administration of the National Contest.
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING.
1. PROMOTION DATES
a. The WITN Racing Challenge (“Promotion”) presented by WITN will begin accepting entries on February 19, 2015 at 12:01 p.m. ET. Entries will be accepted until the published cutoff time for each game as posted on the picks page of this website. The last pick will be 15 minutes prior to the start of the Ford Ecoboost 400 on November 22, 2015. The Promotion ends on or around November 30, 2015.
2. ELIGIBILITY RESTRICTIONS
a. The Promotion is open to all legal residents of the United States and the District of Columbia (except NY and FL) who are 18 years of age or older at the time of entry and who live in the State of North Carolina. Employees of WITN (the “Station”), its parent, subsidiary, and affiliated entities, its advertising agencies, participating Promotion Sponsor(s)/promotional partners, other broadcasting stations in the Greenville-New Bern-Washington DMA metropolitan area, and the members of their immediate families (spouse, parents, siblings or children) or households (whether related or not) are ineligible to participate or win. This Promotion is subject to all applicable federal, state, and local laws and regulations. Void outside the United States, in NY and FL, as applicable, and where prohibited.
b. One entry per person. Generally, there are no restrictions on how often a prize may be won by a user over a period of time.
c. Selected winner may be required to provide a valid state issued ID to verify age and identity, to complete the Gray Television Group, Inc. General Appearance/Publicity Release, and to complete an IRS Form W-9 (if requested by the Station) when claiming the prize in this Promotion.
d. Entrants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent. The Station will disqualify any entry from individuals who do not meet the eligibility requirements, and will also delete any entry as required by law.
3. HOW TO REGISTER
a. To participate in the Promotion, you may enter via the following method(s):
VIA INTERNET – Entries to win will require users to set up an account for the UPICKEM National Contest and participate in the WITN Racing Challenge by submitting who they think will finish 1st through 10th place for the designated race. Follow the links and instructions on witn.com to access the Promotion’s online contest site by clicking on the “Contest” navigation tab where you will need to register beginning on February 19, 2015 at 12:01:00 p.m. ET. Previous users will be asked to confirm registration information, and you may be asked to create a unique user name for use in this Promotion and all UPICKEM contests. Each entry via Internet must include requested information, including the entrant’s first name and last name, complete postal address (street, city, state, and zip code), email address, telephone number, and date of birth. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible for assigning the email address or the domain associated with the submitted email address. Multiple entrants are not permitted to share the same email address. Entries submitted will not be acknowledged or returned. Use of any device to automate entry is prohibited. Proof of submission of an entry shall not be deemed proof of receipt by Station. The contest/sweepstakes administrator’s computer is the official time keeping device for the Promotion.
b. For purpose of this Promotion, a “Day” shall begin at 12:00:00 a.m. ET and shall end at 11:59:59 p.m. ET.
c. Limit one (1) entry per person. For internet entry, only one entry per email address is permitted.
d. This Promotion is not intended to be used for gambling purposes. If it is determined that an entrant is using this Promotion for gambling purposes, he/she will be disqualified.
4. HOW TO PLAY: Your score for the Promotion will be based on your performance in the National Contest. Here are the pertinent rules established for the National Contest, which will also govern the selection of the Promotion’s winner:
a. For each race, pick the drivers you think will finish in 1st through 10th place for the race. Picks must be submitted 15 minutes before the race is scheduled to start. Entrants will be awarded points depending on how the driver's they select finish the race. 1st place is worth 150 points, 2nd place is worth 125 points, 3rd place is worth 100 points, 4th place is worth 80 points, 5th place is worth 78 points, with the number of points being reduced by 2 points for each subsequent place from 6th place (76 points ) to 43rd place (2 points). Drivers who finish in 44th place and beyond will not receive any points. The total points for the ten drivers you selected for the race becomes the Team Score. There is a 25 point bonus for each driver that comes in the exact place you picked the driver to finish, e.g., if you picked a driver to finish in 2nd place and the driver finishes in 2nd place, you will receive a 25 point bonus to the Team Score. Your total score for the Contest will be the combined sum of your best 15 races.
b. If there is a tie for the most points for a race, the tie breaker will be based first on which tied entrant had the most drivers picked in the correct place for the race. If there is still a tie, the entrant who picked the highest place correct will be declared the winner. If there is still a tie, the computer will randomly select a winner from the remaining entrants that are still tied after the first two tie-breakers. If there are ties for overall score, the entrant with the most points for the most recent race will be declared the winner. If there is a tie, the computer will continue comparing race points for the most recent previous races, one-by-one, until a winner is selected. If any entrant are tied for all the races, the computer will randomly select a winner from the entrants that are tied for all races.
c. Points are awarded for the drivers, not cars. If a entrant picks a driver who qualified for race and a new driver took his/her place before the start of the race, the entrant must pick the new driver. Entrants will not receive points even though the new driver may be racing the car of the driver that the entrant selected. And, if the new driver is not in the list of drivers that can be picked then no entrants shall have the ability to pick that driver.
d. Weekly winners are not posted until the official governing body for the race has released the official race results and any modifications to the finish order have been made. This can be anywhere from 24 to 48 hours after the conclusion of the race. Any modifications to the race results after the official race results are posted will not be considered.
e. In the event of a tie for a weekly prize, the tie breaker will be determined as follows from among all tied participants: (a) the participant’s predicted score from the winning team in that week's designated time-breaker game will be subtracted from the actual score obtained by the winning team, and the difference multiplied by itself, (b) the participant's predicted score from the losing team in that week's designated time-breaker game will be subtracted from the actual score obtained by the losing team, and the difference is multiplied by itself, (c) the result in (a) is added to the result in (b) to obtain the "Score Approximation." The participant with the lowest "Score Approximation" will be deemed the winner. If a tie remains, the weekly winner will be chosen at random from among those still tied. In the event of a tie for the grand prize, the participant with the lowest total "Score Approximation" for week 21, the championship game, will be declared the winner, then, if necessary, working back through the Score Approximations for each of the preceding weeks to break the tie.
f. Participants agree to abide by the terms of these Official Rules and that the decisions of the Station are final and binding on all matters pertaining to the Contest.
g. Entrants do not need to watch the Station or be present to win.
- Up to thirty-seven (37) local weekly prizes:There will be one “local” prize
awarded from the pool of WITN eligible registered players each race. The week’s top point’s earner will receive a local prize, namely, a Hardee’s® Prize Pack consisting of coupons for two (2) free 1/3 lb Original Thickburgers®, two (2) free 3-piece Hardee’s® Hand-Breaded Chicken Tenders™ and three (3) free Hardee’s® Made From Scratch Biscuits™. Approximate Retail Value: $28.43. Coupon expiration dates and other terms and conditions apply.
b. One (1) overall local grand prize winner: The overall local grand prize winner will be awarded Hardee’s® Hand-Breaded Chicken Tenders™ for A Year, consisting of 52 coupons for one (1) free 3-piece Hardee’s® Hand-Breaded Chicken Tenders™. Approximate Retail Value: $202.28. Coupon expiration dates and other terms and conditions apply.
c. All prizes shall be awarded as coupons upon confirmation of eligibility and receipt of all requisite prize winner paperwork.
6. WINNER SELECTION AND NOTIFICATION
a. Decisions of Station management with respect to the Promotion are final.
b. Selected weekly winner(s) will be determined and notified via the email address they provided when they registered for the Promotion no later than seven (7) days following each weekly game, and the grand prize winner will be notified no later than November 30, 2015 via the email address they provided when they registered for the Promotion.
c. The Promotion is not a chance drawing. The odds of winning will only be determined by the number of eligible entries.
d. Promotion winner(s) will be selected by ranking through the Second Street UPICKEM National Contest mechanism. Selected winner(s) will be notified by Station via email. Winner(s) must execute and return any required affidavit of eligibility and/or liability/publicity release within ten (10) days of notification attempt or winner(s) will be disqualified and the prize will be forfeited and an alternate winner may be chosen by the next highest ranking, or if a tie, by random selection from qualified participants. If a potential winner cannot be contacted, fails to complete, sign and return the required affidavit of eligibility and liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, the potential winner will be disqualified and will forfeit the prize.
e. All posted results are unofficial until winners are verified. Unless otherwise specified in the prize notification, all prizes or prize certificates will be sent via FedEx to the address provided when the user registered for the UPickem platform and/or contest. The winner(s) will forfeit any prize or prize certificate not claimed within thirty (30) days of notification of availability of the prize. The Station, its Promotion Sponsor, or promotional partner(s) are not responsible for the safe arrival of a prize or prize certificate.
f. Winners do not need to be present, listening, or watching to be selected to win.
g. Winners of the national prizes will be notified by email from Second Street Media, the administrator of the UPICKEM national contest. Each entrant’s participation in the National Contest is governed by separate rules, located at: http://ding.autoracing.upickem.net/autoracing/misc/rules.asp The Station, its Promotion Sponsor(s) and promotion partners are not responsible for the outcome or administration of the National Contest and by entering the Promotion, each entrant agrees to release and hold harmless the Station, its Promotion Sponsor(s) and promotional partner(s), its advertising and promotion agencies, and each of their respective parent, subsidiary and affiliated entities, and the officers, shareholders, directors, employees, agents, representatives, successors, and assigns of each of them harmless against any and all claims or liability arising directly or indirectly from the National Contest.
h. There is no substitution, transfer, or cash equivalent for prizes, except that the Station may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. Other restrictions may apply.
a. Payments of all federal, state and local taxes are solely the responsibility of the winners. Winners will be required to complete and submit an IRS Form W-9 or the equivalent including the winner’s full Social Security Number for receipt of any prize valued at $600 or more or for any prizes awarded by the Station in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in disqualification and forfeiture of the prize.
b. Participating in the Promotion and acceptance of prize constitutes winner’s and guest’s (where applicable) permission for the Station or its agents to photograph, film and record each winner, and to use his/her name, address (city and state), likeness, photograph, voice, biographical information and/or any statements made by him/her regarding the Promotion or its sponsors for purposes of trade, publicity or promotion without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.
c. Prior to awarding any prize or prize certificate, and depending on the nature of the prize and eligibility requirements of the Promotion, the Station in its sole discretion will require verification of Promotion winner’s identification by a showing of valid government-issued photo identification. By participating and/or accepting a prize, entrants, winners and guests (if applicable) agree to release and hold harmless the Station, its Promotion Sponsor(s) and promotional partner(s), its advertising and promotion agencies, and each of their respective parent, subsidiary and affiliated entities, and the officers, shareholders, directors, employees, agents, representatives, successors, and assigns of each of them (collectively, the “Released Parties”) harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the Promotion. The Station will also require eligible Promotion winners and their guests or travel companions, if any (as well as each of their parent(s) or legal guardian(s), if winners, guests or travel companions are under the age of majority in their state of residence), to sign a liability release confirming such consent.
d. The Station, in its sole discretion, reserves the right to disqualify any person (and all of their entries) from this Promotion if he or she tampers with the entry process, the operation of the Promotion, or the operation of the Station’s web channel or is otherwise in violation of the rules. The Station further reserves the right, at its sole discretion, to modify, cancel, terminate or suspend the Promotion, or any part of it, if it is not capable of completion as planned or if any fraud, technical failures or any factor beyond the Station’s control, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion as determined by the Station in is sole discretion. Any attempt by an entrant or any person to deliberately damage any station web channel or to undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws. Should such an attempt be made, the Station reserves the right to seek full prosecution and/or damages from any such individual to the fullest extent permitted by law. The Station’s failure to enforce any term of these Official Rules shall not constitute a waiver of this provision. If due to circumstances beyond the control of the Station, any competition or prize-related event or travel is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to modify, terminate, suspend or cancel the Promotion and shall not be required to award a substitute prize.
e. The Released Parties are not responsible for (i) typographical or other errors in the printing, the offering or the administration of the Promotion, or in the announcement of a prize; (ii) entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties, malfunctions, disconnections, other technological failures, telephone service outages, delays, dropped calls, or busy signals, or any other difficulties that may prevent an individual from sending or receiving a text message; or (iii) lost, stolen, mangled, misdirected, postage due, illegible, incomplete, incorrect, or late entries. Further, the Released Parties are not responsible if any part of a Promotion prize that cannot be awarded due to acts of god, acts of war, natural disasters, weather, acts of terrorism or other factors beyond the Station’s control.
f. To obtain a copy of the Official Rules or a list of winners following completion of the Promotion (please specify which), send a self-addressed, stamped envelope specifying “Official Rules” or “Winner List” to the WITN Racing Challenge Winner List or Official Rules Request, WITN, 275 E. Arlington Boulevard, Greenville, NC 27858. A copy of the Official Rules and a list of winners (when complete) are also available during regular business hours at the main studio of WITN, 275 E. Arlington Boulevard, Greenville, NC 27858. All such requests must be received within thirty (30) days following completion of the Promotion.
